, the appeals court accepted the U.S. Justice Department's claim that TikTok, whose parent company, ByteDance headquarters are in China, could be affected by the Chinese government and have concerns about national security.
Citing the First Amendment to the U.S. Constitution, which states freedom of expression, TikTok argued that the fundamental rights of its parent company and users of the TikTok app were violated by the law, but they were not accepted.The law, collectively known as the
'TikTok Ban Act', took effect, forcing ByteDance to sell TikTok's U.S. business rights or suspend its service in the U.S. within 270 days.The deadline for selling TikTok under the
Act is January 19 next year, just before President-elect Donald Trump's inauguration day.
ByteDance pointed to Trump's opinion that TikTok services should continue during his campaign in a provisional injunction, arguing that the suspension is necessary because Trump needs time to make decisions after taking office.
Trump supported a "no TikTok" during his first presidency (2017-2021), but he has repeatedly said during this presidential campaign that he will seek TikTok to help expand his younger support.
It is not clear whether the Supreme Court will hear TikTok's re-appeal or appeal, but there are observations that the Supreme Court is quite likely to say it will because it has a large impact.
